Divorce
Florida provides for no-fault divorce, so a marriage may be dissolved by alleging that it is irretrievably broken. We handle contested and uncontested cases, from filing or answering the petition through the final decree.
Time-Sharing
Florida law refers to custody as time-sharing, decided under a best interest of the child standard and set out in a parenting plan covering where the child resides and how decisions are made.
Child Support
Support is calculated on an income-shares model using the Florida Child Support Guidelines (Florida Statute 61.30). Both parents file financial affidavits listing their incomes and expenses.
Alimony
Alimony is based on one party’s financial need and the other party’s ability to pay. Florida recognizes durational, rehabilitative, bridge-the-gap and temporary awards; permanent alimony no longer exists as of 2023.
Property Division
The marital estate, including both assets and debts, is divided under an equitable distribution standard. Courts may order unequal distribution based on factors such as the length of the marriage and each party’s economic circumstances.
Adoption
We handle contested and uncontested adoptions, including adoptions by family members, foreign adoptions and independent adoptions. In most cases the biological parents’ rights must first be terminated.
Paternity
A paternity action safeguards both parents’ legal rights and responsibilities, including support, inheritance, visitation and decision making. Paternity may be established voluntarily, through marriage or by court action.
Parental Relocation
Where a final order establishes time-sharing, moving more than fifty miles from the child’s principal address requires an agreement or a petition to the court. Florida Statute 61.13001 governs the best-interest analysis.
Prenuptial Agreements
A binding contract entered before marriage that decides which assets and debts become part of the marital estate and how they are distributed. Florida requires it in writing, signed by both parties, followed by a legal marriage.
Injunctions
A court order prohibiting an individual from certain acts. Florida provides injunctions for domestic violence, dating violence, sexual violence, repeat violence and stalking.
Contempt & Enforcement
Remedies available when a party fails to follow a final court order, such as refusing to comply with a parenting plan, failing to satisfy child support or alimony, or violating a restraining order.
